Acceptance of terms
Welcome to Good To Grab. These Terms of Service (the “Terms”) explain how you can use our
platform (mobile app, website, etc.). By using Good To Grab, you agree to these Terms and
enter
into a legal agreement with Good To Grab Private Limited (we, us, our). These rules apply to
everyone who accesses our app or website, including Users (people buying surplus food)
and Partner
Stores (restaurants, cafes, bakeries, shops, etc. that offer surplus food through our
platform). If you
don’t agree with any of these Terms, please do not use our services.
Information We Collect

Age and Capacity: You must be at least 18 years old and legally capable
to use this app and agree to these Terms. By using Good To Grab, you represent that you
meet these requirements and follow all applicable laws.

Account Creation: To use certain features (like placing orders), you
need an account. You can sign up with email/password or via social logins (Google,
Apple, etc.). If you use a social login, you confirm you own that account and allow us
to access basic info (name, email, etc.) as permitted.

Your Information: When you register, make sure all info is truthful and
up-to-date. If you claim or list a business (as a Partner Store), you must own it or
have permission to use its details. Do not impersonate others, provide false details,
create multiple accounts, or try to access someone else’s account or business listing
without permission.

Password Security: Keep your password and account details confidential.
You are fully responsible for activities carried out under your account. If someone uses
your account without permission, that’s your responsibility. Please notify us
immediately if you suspect any unauthorized access or breach of security.

Communications: By creating an account, you agree to receive
service-related messages (order updates, account notifications) via email, SMS, or
in-app notifications. You can opt out of marketing emails, but we will still send you
essential transactional notices.
Changes to Terms
We may update or change these Terms at any time, at our sole discretion. We will post the new
version on our platform with a new “last updated” date. It’s your responsibility to review
the Terms
periodically. Continued use of Good To Grab after changes means you accept the updated
Terms.
Language and Interpretation
We may provide translations of these Terms for convenience, but the English version is always
the
legally binding one. If there’s any conflict between the English version and a translation,
the English
version governs.

Service Changes and Updates: We are always improving Good To Grab.
Features, design, and content may change or be removed over time without notice. Your
device may auto-download updates unless you disable that feature; these updates become
part of our service.

Account Restrictions: For operational or security reasons, we may
disable or restrict access to accounts (for example, if we suspect fraud). If we do
this, you might lose access to your order history or saved data. We won’t be liable for
any such loss.

Usage Limits: We may set reasonable limits on how much you can use our
services (such as order volume) to ensure quality of service for all users.

Testing Features: Sometimes we test new features or interface changes
with a subset of users. This means different users might see different versions or
offers. This helps us improve the platform for everyone.
Disclaimers

Informational Content: All content on the platform (descriptions,
menus, images, etc.) is for informational purposes only. We do our best to keep info
up-to-date, but we are not liable if something becomes outdated, incomplete, or
inaccurate.

Quality and Availability: We do not guarantee the quality, safety,
freshness, or availability of any food or items. Surplus food is offered on an
“as-available” basis by our Partner Stores. For example, a “Magic Bag” is a surprise
assortment and depends on what leftovers a restaurant has; its contents are not
guaranteed in advance. For “Menu” offerings, you can choose exactly what you want to
buy.

Intellectual Property: All images, logos, and trademarks on Good To
Grab belong to us or our licensors. Do not use them without permission. If you believe
your IP rights have been infringed, let us know with details (see the Copyright
section).

Certifications by Partners: If a restaurant shows permits or
certificates (like FSSAI) on their listing, that information is provided by the
restaurant. We do not verify or guarantee these documents. Any reliance on them is at
your own risk.

Fees and Promotions: We reserve the right to add fees (service fees,
convenience charges, etc.) or subscription plans anytime. We may also issue promo codes,
cashback, or vouchers at our discretion. These can change or end without notice. If we
find you abusing a promo (e.g., fraudulent referrals), we may suspend your account or
revoke benefits.
Using the Platform
Placing Orders

Types of Surplus Food: Restaurants on our platform offer surplus food
in two main ways:
1) Magic Bags – mixed leftover items at a discount, and
2) Menu Items – specific surplus dishes or products at a discount.
In both cases, the food is sold directly by the restaurant (Partner Store).

Placing a Reservation/Order: When you place a reservation or order, you
authorize us to send your order details and payment to the restaurant. This
authorization is irrevocable. You must pick up your order during the pickup window shown
in the app. Failure to pick up within the time means the order is complete and no refund
will be given (unless our Refund Policy states otherwise).

Restaurant Fulfilment: The restaurant is fully responsible for
preparing and providing the food. We only facilitate the order. If the restaurant runs
out of surplus food, has an operational issue, or a safety concern, they may cancel your
order. In such cases, we will process a refund per our Refund Policy. We are not liable
for the restaurant’s inability to fulfil an order or any food safety decisions.

Prices and Contents: All prices and descriptions are provided by the
restaurant. We do not set or influence them. Magic Bag contents depend on the
restaurant’s leftover inventory and are not disclosed in advance. Menu item availability
and pricing may change until the moment you place your order.

Pickup: Once you arrive to pick up your order, inspect it on-site.
After you take it, the restaurant (not us) is responsible for food quality, freshness,
allergens, and related issues. If there are problems, you should raise them immediately
with the restaurant.
B. Your Conduct

Respectful Behaviour: Treat restaurant staff, Good To Grab staff, and
other users with respect. No abusive, harassing, discriminatory, defamatory, obscene,
violent, or illegal behaviour is allowed. Such conduct can lead to account suspension or
termination.

Legal Compliance: You agree to use the platform in accordance with all
laws, regulations, and rules applicable in India. Do not engage in illegal activities or
post content that violates national security, public order, or targets any protected
class.

Content of Communications: Any chats, messages, or calls through our
platform must be respectful. We may record or log communications for safety and quality.
If you object, please avoid using these features.

Use of Data and Automation: Do not scrape, copy, or extract data from
our platform for commercial use unless we provide written permission. Do not use bots,
crawlers, or automated tools to access the platform. Follow all instructions in
robots.txt or similar files.

Platform Integrity: Do not disrupt or damage our service. This includes
attempts to hack, reverse-engineer, overload, or introduce malware/viruses. Do not
delete or modify others’ content. No spamming, unsolicited messages, chain letters, or
promotional posts.

IP and Privacy Rights: Do not post anything that infringes on
intellectual property, privacy, or publicity rights. Do not impersonate others, use fake
emails, disguise your identity, or hide the origin of content.

Prohibited Content: Do not post hateful, obscene, pornographic, or
harmful content, especially regarding minors. Do not post fake reviews or misleading
information meant to harm restaurants or manipulate ratings.

Framing and Linking: You may link to Good To Grab only from legal and
appropriate content. Do not frame our website or app within another site.
If you violate any of the above rules, we may immediately suspend or terminate your account
and
take legal action if needed.
Content and Intellectual Property
- Our Content: Good To Grab owns all intellectual property rights on our
platform (software,
text, images, logos, designs, databases, etc.). These are protected by law. We grant you
a
limited, personal, non-exclusive license to use the platform for lawful personal use
only. You
may not copy, modify, distribute, or create derivative works without our written
permission.
- Your Content:When you submit any content (reviews, photos, comments,
ratings, etc.), you
give Good To Grab a worldwide, royalty-free, perpetual license to use, display, modify,
adapt, and distribute that content. We can use it for any lawful purpose (including
marketing
and improvements). You also waive any moral rights on your submissions. You promise that
anything you post is truthful, lawful, and doesn’t infringe anyone’s rights. We reserve
the
right to remove or block any content we consider illegal, harmful, infringing, or in
violation
of these Terms, at our sole discretion.
- Third-Party Content:
We may link to or show content from others (restaurants, third-party
sites, social media, etc.). We do not control, endorse, or guarantee the accuracy of
third-
party content. We are not responsible for any loss or damage from your reliance on it.
- Reviews and Ratings:
User reviews and ratings are personal opinions, not Good To Grab’s
endorsement. If you have a problem with another user’s review, you must address it
directly
with that person or restaurant.
Fees and Payment
- Pricing:The total price for your order (Magic Bag or Menu items) will
be displayed at
checkout. This includes the food cost set by the restaurant, any taxes, and applicable
fees.
You must pay the full amount upfront at the time of reservation.
- Platform Fees:If we charge any service, convenience, or platform fees,
we will display them
to you before you pay. All fees are subject to applicable taxes, which will also be
shown at
checkout.
- Payment Methods:We accept various payment methods. Refunds (if any)
will be made
through the same method you used, unless we issue platform credits or otherwise specify.
Refund timelines depend on your payment provider’s policies.
- No Resale: You agree not to resell or redistribute any food items you
buy through Good To
Grab. All purchases are for your personal use only.
Cancellations and Refunds

Our Role: Good To Grab is not a party to the sale of food — the
contract is between you and the restaurant. Refunds or replacements must be approved by
the restaurant or as allowed by our official Refund Policy.

Fees: We do not refund platform or convenience fees unless:
- A technical error on our side caused the issue.
- The restaurant cancelled because the food became unavailable.
- The situation is explicitly covered under our Refund Policy.

Reporting Problems: If you face an issue (wrong item, spillage,
contamination, etc.), inform the restaurant immediately at pickup. Also notify us with
clear evidence (photos, video, etc.) as soon as possible. We will review and resolve the
case as per our policies.

Special Instructions: Restaurants follow special instructions on a
reasonable best-effort basis. If something is handled differently, it may not qualify
for a refund automatically.

Refund Process: If eligible, your refund will be credited back to your
original payment method (or as platform credit if you were paid that way). The exact
time depends on your bank or payment provider.
Order Cancellation Damages
We take your order authorizations seriously. If you cancel or cause a cancellation of an
order for
reasons not our fault (for example, you gave wrong info, were unreachable, didn’t show up,
or
simply changed your mind), this breaches your unconditional authorization. In that case, you
agree
to pay liquidated damages equal to the loss suffered by the restaurant (basically the value
of what
they prepared or reserved). We may recover this amount by deducting it from your account or
future orders.
No Penalty for Our or Restaurant’s Fault: If a cancellation occurs due to
our system or
technical error, or because the restaurant couldn’t fulfil the order (no stock, etc.), you
won’t
be charged. If you already paid, we will refund you in that event.
Disclaimers and Limitation of Liability
A.Disclaimer of Warranties
We provide Good To Grab “as is” and “as available”. To the fullest extent
allowed by law, we
(and
our officers, directors, employees, agents) disclaim all warranties – express, implied, or
statutory.
This includes but is not limited to warranties of merchantability, fitness for a particular
purpose,
accuracy, non-infringement, or any other promise about the service.
We make no promises about:
Indemnification
- The accuracy, completeness, or reliability of any content or listings.
- The quality, safety, hygiene, or suitability of any food from Partner Stores.
- Any personal injury or property damage resulting from consuming food bought through our
app.
- The availability, uptime, or performance of the platform.
- Security of the platform or your data (we follow reasonable practices, but we cannot
guarantee against every risk).
- Conduct of any restaurants or other users.
Any advice or information we provide (written or spoken) does not create any warranty. If you
download any materials or data from our site or app, you do so at your own risk.
B. Limitation of Liability
- Errors or inaccuracies in listings or content.
- Personal injury, illness, or property damage from consuming food.
- Unauthorized access to or alteration of your data.
- Any interruption or suspension of service.
- Transmission of viruses or malware.
- Loss of data, revenue, or business.
- Reliance on any content or user-generated reviews.
- Failure to secure your account credentials.
- Actions or omissions of restaurants (e.g., food quality or availability issues).
- Events beyond our reasonable control (such as natural disasters or third-party
failures).
Aggregate Cap: Our total liability to you for any claim is limited to the
amount you actually paid for
the specific order that gave rise to the claim, to the extent allowed by law. In other
words, we are
not liable for more than your purchase price for that order.
C. Indemnification
You agree to indemnify and hold harmless Good To Grab and its officers, directors, employees,
and
agents from any claims, damages, losses, liabilities, or expenses (including legal fees)
arising from:
- Your breach of these Terms or misuse of the platform.
- Your violation of any law or the rights of a third party.
- Content you submit (like reviews or comments).
- Your involvement in any disputes over food or service (including any health issues from
food you consume).
We reserve the right to take over the defence of any claim at our own expense. You agree not
to
settle any claim on our behalf without our written consent.
Termination

Your Right to Close Account: You can delete your Good To Grab account
anytime by going to Profile → Settings → “Delete Account,” or by contacting support.

Our Right to Suspend/Terminate: We can suspend or terminate your access
to the platform without prior notice for any reason, including violations of these
Terms, fraud, misuse of the platform, or prolonged inactivity.

Effect of Termination: If your account is terminated, we may delete or
deactivate your account, limit access to your data, and block creation of new accounts.
We are not liable for any loss resulting from termination or data deletion.

Data Retention: Even if you delete your account or orders, we may
retain certain information as required by law (such as transaction records for tax or IT
regulations).
Miscellaneous

Entire Agreement: These Terms, along with our Privacy Policy and any
other policies we provide, form the entire agreement between you and Good To Grab
regarding the platform.

No Waiver: If we do not enforce any right or provision in these Terms,
it does not mean we waive that right.

Severability: If any part of these Terms is found invalid or
unenforceable, the remaining sections will continue in full effect.

No Partnership: Nothing in these Terms creates a partnership, joint
venture, or agency relationship between you and Good To Grab. You are not authorized to
act on our behalf.

Governing Law: These Terms are governed by Indian law. Any disputes
will be resolved exclusively in the courts of Hyderabad, Telangana, India.

Carrier Charges: Using our platform via mobile data may result in
charges from your mobile service provider. We are not responsible for those fees.

Linking to Our Platform: You may link to Good To Grab as long as the
site you link from is lawful and appropriate. You may not create embedded links or
frames to our site without permission.

Good To Grab will never ask for your OTP, CVV, PIN, or full banking details via calls, SMS, or email.
Do not share such sensitive information. Report any suspicious communication claiming to be from
Good To Grab immediately.
